Customized / Personalized / Made-to-Order Product Purchase Agreement and Final Sale Disclaimer

This Customized / Personalized / Made-to-Order Product Purchase Agreement and Final Sale Disclaimer (“Agreement”) applies to any product purchased from Bibersoner, operated by KUBULALA INTERNATIONAL LIMITED, that is customized, personalized, specially produced, made-to-order, or prepared according to customer-specific selections, instructions, uploaded files, specifications, or approved design details.

By placing an order for a customized, personalized, made-to-order, or exclusive product, you acknowledge, agree, and confirm the following terms.


1. Customized Product Definition

For the purposes of this Agreement, customized, personalized, made-to-order, or exclusive products include, but are not limited to:

  1. products with custom text, names, initials, numbers, dates, logos, slogans, messages, or other personalized content;
  2. products using customer-uploaded images, artwork, photos, files, designs, or documents;
  3. products made according to customer-selected size, color, material, style, quantity, specification, or combination;
  4. products specially produced, printed, engraved, embroidered, assembled, modified, or prepared for a specific customer;
  5. custom bundles, special orders, exclusive products, or non-standard product configurations;
  6. any item that is not held as normal inventory and is produced or prepared specifically for the customer.

2. Customer Confirmation Before Production

Before submitting your order, you confirm that you have carefully reviewed all order and customization details, including but not limited to:

  1. product type;
  2. size;
  3. color;
  4. material;
  5. quantity;
  6. spelling;
  7. names, initials, numbers, and dates;
  8. uploaded images, artwork, logos, or design files;
  9. design placement, layout, and specifications;
  10. shipping address;
  11. contact information.

You understand that the product will be produced according to the information, files, selections, and instructions submitted or approved by you.


3. Customer Responsibility for Submitted Information

You are fully responsible for the accuracy, completeness, quality, and suitability of all information, text, files, images, artwork, logos, designs, and specifications submitted by you.

Bibersoner is not responsible for errors caused by customer-submitted or customer-approved information, including but not limited to:

  1. spelling mistakes;
  2. incorrect names, initials, dates, or numbers;
  3. wrong size, color, material, style, or product selection;
  4. wrong quantity;
  5. incorrect or incomplete shipping address;
  6. low-resolution, blurry, distorted, incomplete, or unsuitable images;
  7. wrong uploaded files;
  8. design mistakes submitted or approved by the customer;
  9. customer misunderstanding of product size, scale, color, or appearance.

If the final product is made according to the details submitted or approved by you, the product will not qualify for cancellation, return, exchange, or refund due to errors in your own submission or approval.


4. Final Sale Disclaimer

Because customized, personalized, made-to-order, and exclusive products are produced specifically for you and may not be suitable for resale, all such products are considered final sale once production, customization, material preparation, printing, engraving, assembly, packaging, or procurement has started.

This means that customized products are generally:

  1. non-cancellable;
  2. non-returnable;
  3. non-exchangeable;
  4. non-refundable.

By placing an order, you acknowledge and agree that once production or preparation begins, the order cannot be canceled, returned, exchanged, or refunded unless the issue is caused by our confirmed error.


5. No Return or Refund for Customer-Based Reasons

Customized, personalized, made-to-order, or exclusive products are not eligible for return, refund, or exchange for customer-based reasons, including but not limited to:

  1. change of mind;
  2. no longer wanting the product;
  3. ordered by mistake;
  4. wrong size selected by the customer;
  5. wrong color selected by the customer;
  6. wrong material selected by the customer;
  7. wrong style or product selected by the customer;
  8. wrong quantity selected by the customer;
  9. incorrect spelling, names, initials, dates, numbers, or text submitted by the customer;
  10. wrong image, logo, artwork, or file uploaded by the customer;
  11. low-resolution or poor-quality image uploaded by the customer;
  12. customer dislikes the design after production based on their own submission or approval;
  13. minor differences between screen display and the final physical product;
  14. minor differences in color tone, placement, scale, material texture, or finishing;
  15. delivery delay caused by incorrect customer information, customs clearance, courier issues, or force majeure events.

6. Normal Production Tolerance

You understand and agree that customized products may have minor production variations.

Such variations may include, but are not limited to:

  1. slight color differences;
  2. minor size tolerance;
  3. slight print placement differences;
  4. slight engraving depth differences;
  5. minor stitching or finishing variations;
  6. material texture differences;
  7. small differences between digital preview and physical product;
  8. lighting or screen display differences.

These normal production variations do not qualify as defects unless the deviation is substantial and clearly inconsistent with the confirmed order details.


7. When a Customized Product May Qualify for Remedy

A customized, personalized, made-to-order, or exclusive product may qualify for a replacement, remake, partial refund, full refund, store credit, or other remedy only if:

  1. the item arrives damaged;
  2. the item has a clear manufacturing defect that affects normal use;
  3. the wrong item was sent;
  4. the product was made materially different from the confirmed order details due to our error;
  5. the customization error was caused by Bibersoner, not by the customer’s submitted or approved information.

To request a review, you must contact us within 7 days after delivery.

Your request must include:

  1. order number;
  2. full name;
  3. email address used for the order;
  4. detailed explanation of the issue;
  5. clear photos of the product;
  6. clear photos of the packaging;
  7. clear photos of the shipping label;
  8. videos or additional evidence if requested.

After review, Bibersoner will determine the appropriate solution at its discretion and in accordance with applicable law.


8. Cancellation Before Production

You may request cancellation within 12 hours after payment, provided that:

  1. production has not started;
  2. customization has not started;
  3. materials have not been prepared;
  4. printing, engraving, embroidery, assembly, or modification has not started;
  5. packaging has not started;
  6. shipment arrangement has not started.

If any of the above has already started, cancellation may not be possible.


9. Production Approval

If a design proof, preview, mockup, sample image, or confirmation request is provided before production, you are responsible for reviewing it carefully.

Once you approve the design, preview, proof, or order details, production may begin based on your approval.

After approval, changes may not be possible. If changes are requested after approval, additional fees, production delays, or cancellation restrictions may apply.


10. Intellectual Property Confirmation

By uploading or submitting any image, logo, artwork, text, design, file, or other material, you represent and warrant that:

  1. you own the material or have the legal right to use it;
  2. the material does not infringe any copyright, trademark, design right, privacy right, publicity right, or other third-party right;
  3. the material is not unlawful, offensive, defamatory, obscene, hateful, misleading, or harmful;
  4. you authorize Bibersoner and its service providers to use the submitted material solely for processing, producing, customizing, fulfilling, documenting, and supporting your order.

You agree to indemnify and hold Bibersoner harmless from any claims, losses, damages, expenses, or legal fees arising from materials submitted by you.


11. Customer Acknowledgement

By placing an order for a customized, personalized, made-to-order, or exclusive product, you acknowledge and agree that:

  1. you have reviewed all customization details before submitting the order;
  2. the product will be made according to your submitted or approved information;
  3. you are responsible for any errors in your submitted or approved information;
  4. once production or preparation begins, the order is final sale;
  5. customized products are generally not eligible for cancellation, return, exchange, or refund;
  6. minor production variations are normal and do not automatically qualify as defects;
  7. remedies are available only where the issue is caused by Bibersoner’s confirmed error, damage, defect, or incorrect fulfillment.
